Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the AeroTrack IQwebsite, applications, and services (collectively, the “Service”) provided by AeroTrack IQ LLC (“AeroTrack IQ,” “we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility and Accounts
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account. The Service may be used by student pilots who are minors only under the supervision of, and through an account managed by, a certificated flight instructor, flight school, or a parent or legal guardian who accepts these Terms on the minor's behalf and is responsible for the minor's use of the Service.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and to keep it current. Notify us promptly of any unauthorized use of your account.
2. Description of the Service
AeroTrack IQpassively captures flight data — including Automatic Dependent Surveillance-Broadcast (ADS-B) telemetry received from the ground and flight tracks you or third parties upload — and produces training and operational aids such as debrief scorecards, maneuver detection, ACS-referenced scoring, stabilized-approach flags, fleet-utilization reports, and automatically generated logbook entries. The Service is a supplemental training and record-keeping tool only.
The Service is not a certified, approved, or airworthy aviation device or data source and is not to be used for aircraft operation, navigation, separation, or as a system of record for regulatory compliance. Your use of the Service is additionally subject to our Aviation Disclaimers, which are incorporated into these Terms by reference.
3. Data Accuracy; No Reliance
Flight data is derived from third-party signals and uploads and may be incomplete, delayed, interrupted, or inaccurate. Maneuver detection, scoring, and safety flags are produced by automated algorithms that may not detect every event, may report events that did not occur, and are not a substitute for the judgment of a certificated flight instructor or pilot in command.
Automatically generated logbook entries and flight-hour tallies are a convenience only. You remain solely responsible for the accuracy, completeness, and regulatory compliance of your own logbook and records, including verifying every entry before relying on it for any certificate, rating, currency, or endorsement. You agree not to rely on the Service for any decision that affects the safety of flight.
4. Acceptable Use
You agree not to, and not to permit anyone to:
- use the Service in any manner that could interfere with, disrupt, or create an undue burden on the Service or its infrastructure;
- use the Service for aircraft operation, navigation, air-traffic separation, or any safety-of-flight purpose;
- upload or transmit any data you do not have the right to share, or that infringes the rights of others or violates any law;
- attempt to gain unauthorized access to the Service, other accounts, or related systems, or to reverse engineer, decompile, or derive source code except to the extent permitted by law;
- surveil, track, or profile any individual or aircraft without a lawful basis and appropriate authorization; or
- resell, sublicense, or provide the Service to third parties except as expressly permitted by us in writing.
5. Subscriptions, Fees, and Billing
Certain features of the Service require a paid subscription. Pricing, plan features, and any promotional or founding-partner rates will be presented to you at the time of purchase and are subject to the terms disclosed there. Unless stated otherwise, fees are billed in advance, are non-refundable except where required by law, and exclude applicable taxes.
We may change our fees on a going-forward basis. Any founding-partner or early-access discount applies only as described at the time it is offered and on the terms then disclosed. We will provide notice of material pricing changes to your plan before they take effect.
6. Intellectual Property
The Service, including its software, design, text, graphics, and all related intellectual property, is owned by AeroTrack IQ LLC and its licensors and is protected by law. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your internal training and operational purposes.
You retain ownership of the flight data and other content you submit (“Your Content”). You grant us a worldwide, royalty-free license to host, process, and use Your Content as necessary to provide and improve the Service. We may use aggregated and de-identified data — from which you and any individual cannot reasonably be identified — for analytics, product development, and other lawful business purposes.
7. Third-Party Services
The Service may rely on or interoperate with third-party services and data sources, including ADS-B receivers and providers and electronic flight-bag applications such as ForeFlight. We do not control and are not responsible for third-party services, and your use of them may be governed by separate terms. The availability and accuracy of third-party data is outside our control.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, AeroTrack IQ LLC disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any data, score, flag, or record it produces will be accurate, complete, or reliable.
9. Limitation of Liability
To the fullest extent permitted by law, AeroTrack IQ LLCand its officers, members, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or for any personal injury, death, or property damage, arising out of or related to your use of, or inability to use, the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.
10. Indemnification
You agree to defend, indemnify, and hold harmless AeroTrack IQ LLCand its officers, members, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your use of the Service; (b) Your Content; (c) your violation of these Terms or of any law or third-party right; or (d) any decision or action taken in reliance on the Service, including any conduct of flight.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we believe you have violated these Terms. Upon termination, your right to use the Service ceases. Sections that by their nature should survive termination — including data accuracy, disclaimers, limitation of liability, indemnification, and governing law — will survive.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. You agree that the state and federal courts located in Utah will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, and you consent to personal jurisdiction and venue there. You and AeroTrack IQ agree that any claim must be brought in an individual capacity and not as part of any class or representative proceeding.
13. Changes to the Service and Terms
We may modify or discontinue the Service, in whole or in part, at any time. We may also update these Terms from time to time. If we make material changes, we will provide notice by reasonable means, such as posting the updated Terms with a new effective date or notifying you through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
14. Miscellaneous
These Terms, together with the Privacy Policy and Aviation Disclaimers, constitute the entire agreement between you and AeroTrack IQ LLC regarding the Service. If any provision is held unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for any failure or delay caused by events beyond our reasonable control.
